Welcome to Tonit. These Terms of Service ("Terms") govern your access to and use of the Tonit mobile application and related services (together, the "Service"). Please read them carefully. By creating an account, tapping to agree on the sign-in screen, or otherwise using the Service, you agree to these Terms, our Privacy Policy, and our End User License Agreement (EULA). If you do not agree, do not use the Service.
In short. Tonit is for adults. Be respectful, report problems, and use Report and Block when you need to. Optional Coins and Tonit VIP are sold through the App Store. Chatting is always free.
Tonit is a companion app built around tonight. You can share what you are up for tonight, browse plans from others, send a Ping to join a plan, chat one-to-one, and share moments in Community.
Tonit is not a background-check service, an employment marketplace, or a platform for selling goods or paid personal services. Features may change over time as we improve the Service.
We may refuse, suspend, or terminate accounts that appear to be fake, duplicated, automated, or created to evade a prior ban.
Posting a plan, sending a Ping, or joining a conversation does not guarantee that anyone will reply.
Tonit has zero tolerance for objectionable content and abusive users. When you use the Service, you agree not to:
Every plan, post, comment, profile, and chat can be reported or blocked from within the App. When you report or block a user, their content is removed from your view immediately. We act on reports within 24 hours and will remove content that violates these Terms and suspend or permanently ban the users responsible.
We may remove content or restrict features without prior notice when we reasonably believe it is needed to protect users or the Service. Repeated or severe violations may result in a permanent ban without refund of unused Coins or remaining VIP time, except where required by law or by Apple's refund policies.
The Service offers optional in-app purchases. The App shows the details of each purchase before you confirm it. All purchases are made through Apple's App Store and are subject to Apple's terms and policies in addition to these Terms. Payment is charged to your Apple Account when you confirm a purchase.
We may change the features, free daily allowances, product lineup, or availability of Coins and VIP. If we make a change that materially reduces the benefits of an active subscription, it will apply from your next renewal period unless applicable law requires otherwise.
You keep ownership of the plans, posts, photos, comments, and messages you create ("Your Content"). By sharing Your Content through the Service, you grant Tonit a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute it solely to operate, protect, and improve the Service. This license ends when Your Content is deleted from the Service, except for copies we must keep for legal, security, or backup reasons for a limited time.
You are responsible for Your Content and confirm that you have the rights to share it and that it does not violate these Terms or anyone's rights. We may remove Your Content if we believe it violates these Terms or the law.
The Service, including its design, software, logos, and the Tonit name, is owned by us and protected by intellectual property laws. Except for the limited license granted in the EULA, nothing in these Terms gives you any right to use our trademarks or other intellectual property.
The Service relies on Apple platforms for distribution, Sign in with Apple, and in-app purchases. Your use of those features is also subject to Apple's applicable terms. We are not responsible for outages or decisions made by Apple outside our control.
We may suspend or terminate your account, remove Your Content, or restrict access to the Service at any time if we reasonably believe you have violated these Terms, created risk for other users, or exposed us to legal liability. You may stop using the Service and delete your account at any time from Me, then Settings, then Delete Account.
After termination, provisions that by their nature should survive—including ownership, licenses already granted for legal retention, disclaimers, limitations of liability, and indemnity—will continue to apply.
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, or that content will always be available.
To the fullest extent permitted by law, Tonit will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising from your use of the Service or from interactions with other users.
Our total liability for any claim relating to the Service is limited to the amount you paid us through in-app purchases in the twelve months before the claim arose, or if you have not paid through in-app purchases, to the maximum amount permitted by applicable law for a no-fee claim.
You agree to defend, indemnify, and hold harmless Tonit and its developers, officers, and agents from any claims, losses, or expenses arising from Your Content, your use of the Service, your interactions with other users, or your violation of these Terms.
We may update these Terms from time to time. When we make material changes, we will update the date at the top of this page and, where appropriate, notify you in the App. Continuing to use the Service after an update means you accept the revised Terms.
These Terms are governed by the laws of the jurisdiction in which the developer of Tonit is established, without regard to conflict of law rules. Nothing in these Terms limits any rights you have under the mandatory consumer protection laws of the country where you live.
These Terms, together with the Privacy Policy and EULA, are the entire agreement between you and us regarding the Service and replace any prior understandings on the same subject. If a court finds a part of these Terms unenforceable, the rest remains in effect.
